TCL Settles 120Hz Class Action in California Out of Court

A class action in California has been settled by TCL for $2.9 million over a claim by TCL that its sets were deceptively advertised as having “120Hz CMI,” “120Hz Clear Motion Index,” and/or “120Hz CMI Effective Refresh Rate” when they used 60Hz panels. The claim is online here.

Payments of up to $40 are available to buyers of the affected sets. Claims can be made here.

TCL did not go to court and said that it believes it told the truth and did not mislead. (the sets used backlight scanning to improve motion performance)

What We Think

I think that I, too, would have been unhappy about buying such a TV and finding that it only ran at 60Hz. No doubt if TCL had been sure it would win, it might have gone to court.

I can’t imagine that many consumers would be bothered to claim for $15 per set, but no doubt the lawyers were pleased to have their bills paid. (BR)
