A California federal judge has determined that the smart TV owners that accused Vizio of collecting and sharing their viewing habit data without consent, can now move forward with their claim. This is the next stage in the case where Vizio was accused of violating both the Video Privacy Protection Act and Wiretap Act by secretly tracking everything consumers watch and then selling the information. We have previously reported that Vizio was fined $2.2 million by the FTC as the company had violated both the Video Privacy Protection Act and Wiretap Act (Vizio Fined US$2.2 million by FTC). The smart TV owners can now continue with their fraud and federal privacy law violation claims. Other allegations were dismissed by the judge.
