Law360 reports that the proposed class action against Apple over display defects in the MacBook Pro notebook has been dismissed. (Judge Reveals Mac PC Display Problems Apple ‘Tried To Hide’). The action was dismissed as ‘the proposed class failed to argue the alleged defect posed a safety hazard or that Apple fraudulently concealed the purported defect’.
What We Think
I would not want to put in the amount of time and effort to really understand the US law on class actions! Thank heavens there are those that do. I feel closer to the Japanese view of the law. A US lawyer I knew (with Japanese parents) was sent to Japan to work in a local law firm. At one point, he told me, he diverted a huge potential claim for damages related to a workplace injury, by going the house of the victim in his best suit, bowing deeply and apologising profusely to the victim. I can’t see that working in California (or the UK!). (BR)
