Absen Prevails in LED Patent Case

What They Say

Absen’s lawyers posted a detailed article about the defeat of a patent dispute brought by Ultravision against Absen. The firm said that all of the claims were defeated and that Ultravision has taken action against ‘nearly 40’ display companies in the last three years. The action against Absen was started in March of 2018 with an ITC case. That was dropped by Ultravision in November 2018.

Shortly after the ITC case ended, however, Ultravision sought to expand the dispute in co-pending district court case in the Eastern District of Texas by increasing the number of asserted patents from two in the ITC to eight in the district court. Although the case was consolidated for discovery purposes with six other defendants, each of those defendants settled with Ultravision before trial. Absen did not settle. Absen continued to trial, becoming the first Ultravision target to have the case decided on the merits.

What We Think

We reported on early successes for Ultravision in some of its cases in 2017 (Ultravision International Wins LED Patent Infringement Lawsuit). However, this one seems to have gone badly for the firm. (BR)
